IP and DMCA Takedown Policy

Effective Date: April 1, 2026

Wizcart Technologies Inc. ("Wizcart") respects intellectual property rights and expects all Users and Service Partners to do the same. This Policy describes how to report alleged intellectual property infringement on the Wizcart Platform and how Wizcart responds to such reports.

1) Copyright Infringement — United States (DMCA)

Wizcart complies with the Digital Millennium Copyright Act (17 U.S.C. §512) ("DMCA"). If you believe that content posted on the Platform infringes your copyright, you may submit a takedown notice to our designated DMCA Agent.

1.1 Filing a DMCA Takedown Notice

Your notice must include:

  • a physical or electronic signature of the copyright owner or authorized agent;
  • identification of the copyrighted work(s) claimed to be infringed;
  • identification of the material that is claimed to be infringing, with sufficient detail for us to locate it on the Platform (e.g., URL);
  • your contact information (name, address, phone number, email);
  • a statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law; and
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

1.3 Counter-Notification

If you believe your content was removed in error, you may file a counter-notification including:

  • your physical or electronic signature;
  • identification of the removed material and its location before removal;
  • a statement under penalty of perjury that you believe the material was removed as a result of mistake or misidentification;
  • your name, address, and phone number; and
  • a statement that you consent to jurisdiction of the federal district court for the judicial district in which your address is located (or any judicial district in which Wizcart may be found).

Wizcart will forward the counter-notification to the original complainant, who then has 10 business days to file a court action seeking a restraining order. If no such action is filed, the content may be restored within 10 to 14 business days of receipt of the counter-notification.

1.4 Repeat Infringer Policy

Wizcart will terminate or disable the accounts of users who are repeat infringers of copyright, in appropriate circumstances determined by Wizcart in its sole discretion.

2) Copyright Infringement — Canada

For users in Canada, Wizcart also complies with the Copyright Act (R.S.C., 1985, c. C-42), including the notice-and-notice regime.

2.1 Notice-and-Notice Process

If a copyright owner sends a compliant notice of alleged infringement:

  • Wizcart will forward the notice to the person identified in the notice as the alleged infringer;
  • Wizcart will retain records of the forwarded notice and the identity of the person for six months (or twelve months if a court proceeding is commenced); and
  • Wizcart is not required to remove or disable access to the material upon receipt of a notice (unlike the DMCA takedown process).

2.2 Voluntary Removal

Notwithstanding the notice-and-notice regime, Wizcart reserves the right to voluntarily remove content that it reasonably believes infringes intellectual property rights or violates its Terms of Use.

3) Trademark Complaints

If you believe that content on the Platform infringes your trademark rights, please send a complaint to legal@wizcart.com including:

  • the trademark(s) at issue (including registration numbers, if applicable);
  • the specific content you believe is infringing, with URLs or screenshots;
  • your contact information; and
  • a statement of your good-faith belief that the use is unauthorized.

Wizcart will review the complaint and take appropriate action, which may include removing or disabling access to the content.

4) General

4.1 Good Faith

This Policy exists to address legitimate intellectual property concerns. Knowingly filing false or misleading takedown notices or complaints may give rise to liability under applicable law (including 17 U.S.C. §512(f) under the DMCA).
