Definitions

The following capitalized terms, as used in this Privacy Policy, shall have the meanings set out below. Capitalized terms not defined here shall be interpreted in accordance with their ordinary meaning:

"Platform" means the Wizcart websites, mobile applications, and related online services operated by Wizcart Technologies Inc.

"User" means an individual or entity that accesses or uses the Platform to request or receive Services.

"Service Partner" means an independent contractor or independent business that offers or performs Services through the Platform. Service Partners are not employees, agents, dependent contractors, or representatives of Wizcart.

Wizcart Technologies Inc. ("Wizcart," "we," "us," or "our") respects your privacy and is committed to safeguarding your personal information in accordance with applicable privacy laws in Canada and the United States, and, where applicable, the European Union/UK (e.g., PIPEDA, Quebec Law 25, CCPA/CPRA, VCDPA/CPA/CTDPA/UCPA, GDPR/UK GDPR).

This Privacy Policy describes:

  • What personal information we collect and how
  • How we use and disclose personal information
  • Your rights and choices
  • How we secure and retain your information

This Policy applies to:

  • Visitors to our websites and apps (the "Platform") at wizcart.com and related domains
  • Individuals booking services through Wizcart ("Users")
  • Independent businesses and professionals offering services through Wizcart ("Service Partners")

If you are a Service Partner, please also review the Wizcart Service Partner Terms of Use. If you are a User, review the Wizcart User Terms of Use.

1) Who We Are and What We Do

Wizcart provides a technology marketplace that connects Users with independent Service Partners (e.g., babysitters, pet sitters, locksmiths, home salon professionals) and facilitates bookings and payments via third-party payment processors (e.g., Stripe Connect).

Wizcart operates solely as a software facilitator and payment processing intermediary. Wizcart does not provide, perform, supervise, direct, or control any Services. Service Partners are independent businesses that set their own pricing, hours, and methods. Any agreement to perform Services is between the User and the Service Partner. Wizcart is not a party to any such agreement.

Role:

  • We act as a data controller (or "business") for personal information we collect directly about Users and Service Partners to operate our Platform and our business (e.g., accounts, bookings, payment facilitation, marketplace trust and safety, support, analytics, marketing where permitted).
  • We act as a processor/service provider only in limited cases where a third party directs us how to process data (e.g., handling certain payment events on behalf of the payment processor).
  • We do not sell personal information. We may "share" personal information for cross-context behavioral advertising only with your consent where required, and you may opt out at any time (see Section 9).

2) Information We Collect

Depending on your role and use of the Platform, we collect:

A. Provided by You

Contact & identity: name, phone, email, profile photo, address, age confirmation.

Account & booking: preferences, availability, service categories, booking history, communications via in-app chat, ratings/reviews.

Payment-related: last 4 digits of card (for receipts), billing postal code; for Service Partners — payout details (e.g., bank info via Stripe Connect), tax IDs as required by law.

Verification: We engage Certn Inc. (), an independent third-party verification service provider, to facilitate background screening of Service Partners as part of Wizcart's marketplace trust and safety standards, prior to their activation on the Platform.

Such screening may involve the collection, use, and disclosure of limited personal information such as government identification, licensing or certification details, business or professional history, and, where legally permissible, criminal-record or sanction information, for the purpose of identity verification and marketplace trust and safety.

Wizcart does not conduct background checks itself. All verification is performed by Certn as an independent third-party service provider. Wizcart facilitates these checks only with the Service Partner's express informed consent, obtained through a separate Background Verification Consent and Declaration Form.

Wizcart does not guarantee the accuracy, completeness, or currency of any background verification results provided by Certn or any other third-party verification service provider.

Support content: help tickets, call recordings (where permitted and disclosed), survey responses.

B. Collected Automatically (Web/App/Device)

  • Technical: IP address, device and advertising identifiers, OS/browser type, app version, language, time zone, crash logs.
  • Usage/interaction: pages/screens viewed, taps/clicks, referring URLs, session duration, in-app events.
  • Location: coarse location (IP-based); if you enable device location permissions, we may collect precise geolocation for features like nearby partners (you can disable in OS settings).
  • Cookies/SDKs: first-party cookies, analytics/measurement SDKs (see Section 8).

C. From Third Parties

  • Payments: payment processors (e.g., Stripe) provide tokenized payment confirmations, fraud indicators.
  • Identity/Compliance: verification vendors (where used), sanctions screening signals (as legally required).
  • Platform partners: login partners (if you use social sign-in), mapping/communications partners (e.g., maps/phone masking).

We do not knowingly collect or process sensitive personal information unless such collection is strictly necessary for a purpose described herein. Where such processing of sensitive data is required, we limit its use exclusively to that purpose and implement appropriate technical and organizational safeguards to protect it.

3) How We Use Personal Information

We use personal information to:

  • Provide the Platform: account creation, authentication, bookings, availability calendars, in-app chat, notifications.
  • Facilitate payments and payouts: via Stripe Connect and similar partners; issue receipts, handle refunds/chargebacks.
  • Marketplace trust & safety: fraud prevention, trust and safety screening (including background verification), abuse/spam detection, enforcing our Terms and policies.
  • Support & communications: respond to inquiries; send service, transactional, and security notices; obtain feedback.
  • Improve & personalize: analytics, debugging, research and development, feature testing, user experience tuning.
  • Marketing (where permitted): send offers or recommendations; you can opt out anytime (see Section 9).
  • Legal compliance: tax, accounting, record-keeping; responding to lawful requests and protecting rights.

We may use aggregated/de-identified information for analytics and product improvement and take reasonable steps to prevent re-identification.

4) Legal Bases for Processing

Where applicable (e.g., GDPR/UK GDPR), we rely on:

  • Contract performance (providing the Platform and facilitating bookings)
  • Legitimate interests (e.g., marketplace safety, fraud prevention, product improvement)
  • Consent (e.g., certain marketing, precise location, background checks where required)
  • Legal obligations (e.g., tax, accounting, regulatory requests)

You may withdraw consent at any time (see Section 9). Withdrawing consent does not affect prior processing.

5) How We Share Personal Information

We disclose personal information to:

  • Third-party service providers (vendors): hosting, cloud storage, analytics/measurement, communications, customer support, identity verification, background checks (where applicable), payment processing (e.g., Stripe). These are service providers engaged by Wizcart to operate the Platform — they are distinct from Service Partners who offer Services to Users.
  • Transaction counterparties: a User and their chosen Service Partner see necessary booking details (e.g., first name, booking time/location, and, where applicable, contact information necessary to perform the Service).
  • Compliance & legal: regulators, tax authorities, law enforcement, courts — where legally required or to protect rights, security, or our users.
  • Corporate transactions: acquirers, advisers, or other third parties in connection with a merger, financing, or sale of assets (subject to confidentiality).

All third-party service providers engaged by Wizcart are bound by contractual obligations (e.g., Data Processing Agreements) to use data only for the purposes for which it was provided and to implement appropriate safeguards.

We do not allow third parties to use Platform-derived personal information for their own independent marketing without your consent.

6) Data Residency and Cross-Border Transfers

Our infrastructure and third-party service providers may be located in Canada and the United States. Personal information may be processed and stored outside your province/state or country, and subject to the laws of those jurisdictions.

Where required (e.g., EEA/UK residents), we implement appropriate safeguards for international transfers (e.g., Standard Contractual Clauses and supplementary measures). You may contact us for a copy of relevant safeguards (subject to redactions).

7) Data Retention

We retain personal information:

  • For as long as needed to operate the Platform and fulfill the purposes described above;
  • As required by law (e.g., tax, business, and accounting retention periods, fraud prevention); and
  • As necessary to resolve disputes and enforce agreements.

We may de-identify or aggregate data for longer-term analytics after it is no longer needed in identifiable form.

8) Cookies, SDKs, and Tracking Technologies

We use cookies, pixels, and mobile SDKs to:

  • Authenticate users and maintain sessions;
  • Remember preferences and settings;
  • Measure performance and usage;
  • Detect and prevent fraud/abuse;
  • (Where permitted and with your consent where required) tailor recommendations and marketing.

You can manage cookies via your browser settings and mobile OS permissions; some features may not function without them. We may provide a separate Cookie Notice that offers more detailed information about the types of cookies we use, the purposes for which they are used, and your choices regarding cookie settings.

Microsoft Clarity

We use Microsoft Clarity, a session-recording and analytics service provided by Microsoft Corporation, to help us better understand how Users interact with our websites and applications. Microsoft Clarity uses cookies and similar technologies to collect information such as page views, clicks, scroll behavior, and navigation patterns.

This information is used solely for aggregate analytical and design-improvement purposes and is not employed to personally identify individual Users. Microsoft may process this information on our behalf and combine it with its own analytics data in accordance with the Microsoft Privacy Statement. Data collected through Clarity may be transferred to and stored on servers located in the United States or other jurisdictions with adequate safeguards for cross-border transfers under applicable law.

Your consent choices: - Where required by applicable law (including Quebec Law 25 and GDPR/UK GDPR), Microsoft Clarity analytics cookies will not be activated without your prior consent, which you may provide or decline through our cookie consent mechanism. - You may opt out of Microsoft Clarity's analytics tracking at any time through your browser settings or by visiting the Microsoft Clarity opt-out page.

9) Your Rights and Choices

Your rights depend on your jurisdiction. Subject to legal limits, you may have rights to:

  • Access/Portability — request a copy of your personal information.
  • Correction — update inaccurate information.
  • Deletion — request deletion (e.g., CCPA/CPRA "right to delete"), subject to legal/operational exceptions.
  • Restriction/Objection — object to or restrict certain processing (e.g., direct marketing).
  • Consent choices — withdraw consent (e.g., precise location, marketing, background checks where applicable).
  • Opt-out of sale/share/targeted ads — we do not sell personal information; if we "share" for cross-context behavioral advertising or use data for targeted advertising under state laws, you may opt out at any time.
  • Limit use of sensitive personal information — where applicable by law.

How to exercise: Email privacy@wizcart.com or use in-app settings where available. We will verify your request consistent with applicable law. You may designate an authorized agent (per CCPA/CPRA requirements).

Canada/Quebec: You may contact the Office of the Privacy Commissioner of Canada or your provincial authority (including the Commission d'accès à l'information du Québec) if you are not satisfied with our response.

U.S.: You may have appeal rights under certain state laws; instructions will be provided if we deny your request.

Marketing choices: You can unsubscribe from marketing emails via the link in each email. You will still receive transactional and security communications.

10) Security Measures

We implement administrative, technical, and physical safeguards appropriate to the nature of the information, including:

  • Encryption in transit and at rest (where applicable)
  • Role-based access controls and MFA for internal systems
  • Secure software development practices, logging, and monitoring
  • Risk assessments and workforce privacy/security training

No method of transmission or storage is 100% secure. Please protect your account credentials and notify us immediately of any suspected unauthorized access.

11) Children's Privacy

Our Platform is not intended for use by children, and we do not knowingly collect or solicit personal information from any individual under the age of 13 (in compliance with the U.S. Children's Online Privacy Protection Act — COPPA) or under the age of 16 where applicable under local laws, without verifiable parental or guardian consent.

If we become aware that personal information has been inadvertently collected from a minor without appropriate authorization, we will take reasonable steps to delete such information promptly. Parents or guardians who believe that a child has submitted personal information to Wizcart may contact us at privacy@wizcart.com. We will investigate such requests promptly and take appropriate measures to delete the information.

12) Changes to This Policy

We may update this Policy to reflect legal, technical, or business changes. If we make material changes, we will provide notice (e.g., in-app, email) and obtain consent where required. The "Last Modified" date indicates the latest revision.
