This Trademark Notice is issued by WIZCART TECHNOLOGIES INCORPORATED, a British Columbia corporation (corporation number BC1541387, incorporated 27 May 2025 under the BC Business Corporations Act) extra-provincially registered to carry on business in Alberta (Alberta corporate access number 2128144090).
WIZCART, the WIZCART name, the WIZCART logo, and related brand identifiers are trademarks, trade names, service marks, logos, or brand assets owned or controlled by Wizcart Technologies LLC. The principal Canadian registration is CIPO Trade-mark Registration TMA1136312. The mark is also registered under the Madrid Protocol as International Registration 1504976 and in the United States as USPTO Registration 6,222,464.
The WIZCART trademark is used in Canada by Wizcart Technologies Incorporated under licence from Wizcart Technologies LLC.
Wizcart Technologies Incorporated is authorized to use the WIZCART trademark and related brand assets in Canada in connection with the Wizcart technology marketplace/platform.
Wizcart Technologies LLC controls the character and quality of the Platform Services provided under the WIZCART mark in Canada. Wizcart Technologies LLC exercises quality control through written brand standards, approval processes for material trade-mark uses by Wizcart Technologies Incorporated, and periodic compliance reviews. These quality-control mechanisms are documented in the inter-company licence agreement between Wizcart Technologies LLC and Wizcart Technologies Incorporated.
This notice is provided as public notice that WIZCART is used in Canada under licence from Wizcart Technologies LLC.
Wizcart Technologies Incorporated provides technology marketplace/platform services in Canada. These Platform Services may include access to the Wizcart Platform, account features, booking facilitation, payment facilitation, customer and provider communications, support tools, marketplace policies, promotional features, trust-and-safety processes, and related platform functionality.
The underlying services booked through the Wizcart Platform are Provider Services performed solely by independent third-party Service Providers.
Provider Services are not performed by Wizcart Technologies LLC or Wizcart Technologies Incorporated.
Nothing in this Trademark Notice means that Wizcart Technologies LLC or Wizcart Technologies Incorporated provides, performs, supervises, controls, manages, guarantees, warrants, or insures the underlying Provider Services booked through the Platform.
Independent third-party Service Providers who use the Wizcart Platform are not employees, agents, representatives, partners, franchisees, contractors, subcontractors, workers, staff, technicians, or legal delegates of Wizcart Technologies LLC or Wizcart Technologies Incorporated.
Service Providers are responsible for the manner, means, quality, legality, safety, timing, tools, materials, personnel, licensing, insurance, tax compliance, and performance of the Provider Services they offer or perform through the Platform.
Wizcart may set platform eligibility standards, brand-use rules, documentation requirements, safety requirements, trust-and-safety rules, payment rules, legal-compliance requirements, and marketplace policies. These platform controls do not make Wizcart the employer, supervisor, manager, principal, guarantor, insurer, or provider of Provider Services.
No person or entity may copy, display, use, register, apply to register, modify, imitate, or create any confusingly similar trademark, trade name, logo, domain name, social media handle, business name, app name, design, slogan, or brand identifier based on WIZCART without prior written authorization from the trademark owner or its authorized representative.
Service Providers, customers, partners, vendors, advertisers, and other third parties may refer to Wizcart only in a truthful, non-misleading manner and only as permitted by applicable Wizcart terms, platform policies, brand-use rules, and applicable law.
All rights not expressly granted are reserved by Wizcart Technologies LLC.
Use of the Wizcart Platform or participation in the Wizcart marketplace does not transfer any ownership rights in the WIZCART trademark, logo, brand, goodwill, domain names, platform content, software, or other intellectual property.
Any goodwill arising from use of the WIZCART trademark in Canada inures to the benefit of Wizcart Technologies LLC.
This Trademark Notice should be read together with Wizcart's applicable Terms of Use, Customer Terms, Service Provider Terms, Privacy Policy, Cookie Policy, offer terms, referral terms, and other applicable Platform policies.
If there is any conflict between this Trademark Notice and any other Wizcart document regarding ownership or licensed use of the WIZCART trademark in Canada, this Trademark Notice applies to the extent necessary to confirm that WIZCART is owned or controlled by Wizcart Technologies LLC and used in Canada by Wizcart Technologies Incorporated under licence.
Nothing in this Trademark Notice limits any non-waivable rights that a customer, Service Provider, or user may have under applicable law.
